Rape Accused Proposed Victim Supreme Court Know Whole Matter

New Delhi: The Supreme Court on Thursday suspended the sentence of rape convicts. The reason for this is that the convict and the victim had expressed a desire to marry each other. A bench of Justice Biwi Nagratna and Justice Satish Chandra Sharma asked the couple to give them flowers inside the court room. The Supreme Court said before urging the person to propose to the woman, we met both of them in the lunch session. Both have expressed their desire to marry each other.

The Supreme Court suspended the person’s sentence and said that he (guilty of rape and victim) is ready to marry each other. The details of the wedding will be decided by the parents. We hope that the marriage will take place as soon as possible. Under such circumstances, we suspend punishment and release the petitioner. According to the instructions of May 6, the petitioner appeared before this court today. He will be sent back to jail and will be produced before the respective Sessions Court as soon as possible.

Explain that the convict had challenged the order of 5 September 2024 of the Madhya Pradesh High Court in the Supreme Court, in which his application for suspension of punishment under Section 389 (1) of CRPC was rejected. An FIR was registered against him in 2021. In this, he was accused of repeatedly raping the victim by making false promises of marriage between 2016 and 2021. According to the FIR, the person met the woman through Facebook. She was her sister’s friend. There was a relationship between them. It is alleged that every time he assured him that he would marry her.

At the same time, in another case, the Supreme Court has given a big instruction to the Central Government. The court has said that the government sets dedicated poxo courts on priority basis to especially deal with cases of sexual offenses against children. A bench of Justice Bela M Trivedi and Justice PB Varle said that due to the reduction of special courts for the protection of children from sexual offenses (Poxo) Act, the scheduled deadline is not being followed to complete the hearing.

The Supreme Court said that therefore it is expected that the central and state governments will take appropriate steps to sensitize the officials involved in the investigation of poxo cases. Along with this, courts will also be made for hearing of poxo cases. The court directed to complete the case hearing within the stipulated time besides filing the charge sheet within the prescribed mandatory period.
