‘No drone or super coop who take action in will, High Court comments on ED working style

Chennai. The Madras High Court made strict remarks on the working style of the Enforcement Directorate. The court said that the ED is not a drone that attacks anywhere on its own, nor is it a super cop that start investigating every case that comes to his notice. This comment was made by the High Court two -member bench Justice MS Ramesh and Justice V Laxminarayanan. He was hearing the petition of Chennai -based RKM Powergen Pvt Ltd, in which the company challenged the order to seize a fixed deposit of Rs 901 crore from the ED.

The court showed strictness in the case and said that the ED is not a rotating bomb, which gets torn wherever he wants. He does not have the right to jump into everything. The bench said that according to Section 66 (2) of the Money Laundering Prevention Act, if the ED gets information about the violation of any other law during the investigation, then it cannot investigate the crime herself.

The bench said that the ED has to inform the agency, which is authorized to investigate the crime. The court also said that the ED should investigate any case only when the initial offense is present and due to that the income of the crime has arisen. Without its ED cannot directly investigate.
