Land for Job Case and Lalu Yadav News: Rashtriya Janata Dal (RJD) supremo and former Bihar Chief Minister Lalu Prasad Yadav has suffered a major setback from the Supreme Court. In the famous ‘Land for Job’ scam, the Supreme Court has refused to ban the trial against him. This decision was pronounced by a bench of Justice MM Sundaresh and Justice N. Koteshwar Singh of the Supreme Court.

Lalu Yadav challenged the order of the Delhi High Court in which the High Court refused to stay the trial. During the hearing, the Supreme Court clearly stated that it would not stop the trial and dismiss the appeal. The court said, “When the case is pending in the High Court, why should the Supreme Court intervene?”

However, the Supreme Court has given a limited relief to Lalu Yadav. The court said that they would not need to appear personally during the trial proceedings. Also, the Delhi High Court was ordered to hear Lalu Yadav’s appeal as soon as possible.

A sharp debate over Section 17A

A major legal issue in this case is of Section 17A of the Prevention of Corruption Act. Lalu Yadav’s lawyer, senior advocate Kapil Sibal argued that the CBI started an investigation without necessary government permission, which is mandatory under this section. At the same time, Additional Solicitor General SV Raju, who appeared on behalf of CBI, argued that the matter is before the year 2018, when this section was not applicable, hence permission was not required. Sibal opposed this, saying that FIR took place in 2021 and permission was taken for all other officials, not only for Lalu Yadav.

What is ‘Land for Job’ scam?

Lalu Yadav is alleged to have written the land in exchange for giving people a job in the railway while being the Railway Minister (2005-2009). The CBI registered an FIR in the case in the year 2021 and started an investigation. Lalu Yadav claims that this is a political revenge action and the investigation has started against the rules.
