Retired highcourt judges pension: The Supreme Court on Monday (May 19) took a major decision regarding the pension of the judges of the High Court. The court said that all the retired judges of the High Court will get equal pension and retirement benefits, whether they are permanent judges or additional judges. There will be no discrimination against the judges.

CJI Gawai pronounced the verdict

In the Supreme Court today, a bench of Chief Jestific of India (CJI) BR Gawai and AG Christ heard the pension case of High Court judges on Monday. During this time, the court clearly stated that no judge can be discriminated against on the basis of how he has been appointed in the judiciary. Whether he is taken from the bar or from the lower judiciary, he has come as promoted. All the retired judges of the High Court are entitled to complete and equal pension regardless of their retirement date and source of admission, following the principle of ‘One Rank, One Pension’.

Violation of Article 14 to discriminate against judges

Citing Article 14 of the Constitution, the Chief Justice further said that if there is any kind of discrimination in the terminal benefits after retirement, then it will be a violation of Article 14, so it is decided that all the judges will get full pension. Any discrimination or difference between additional and permanent judges will be against the constitution. Along with this, the court further said that the family of additional judges will also have the right to the same retirement benefits, which the family of permanent judges gets.

Who will get pension?

The Supreme Court in its judgment gave the following instructions to the Central Government-

1. Full pension of Rs 15 lakh will be paid every year to retired Chief Justice of the High Court.

2. All judges including additional judges of the High Court will be given full pension to Rs 13.50 lakh every year.
